Associated Press - November 7, 2009 1:55 PM ET

GENEVA, Neb. (AP) - A Davenport man has been found incompetent to stand trial on charges he neglected his horses.

Fillmore County Judge Jack Ott ruled Wednesday that 66-year-old Norman Graves wouldn't be fit for trial for the foreseeable future.

Graves faces 23 counts of abandonment or cruel neglect of animals and two counts of cruelly mistreating an animal.

The charges involved 38 horses, nearly all of them thoroughbreds. Authorities said the animals were severely malnourished and near death when found in July.
