S.D. Supreme Court Upholds Hyperion Air Quality Permit

The South Dakota Supreme Court has approved an air quality permit that would allow construction to begin on the proposed 10 billion dollar oil refinery Hyperion.

Opponents had previously sued the Board of Minerals and Environment saying it made a big mistake when it approved Hyperion's permit by not including a full–blown environmental impact statement in its study.

Hyperion and the board responded saying such statement wasn't required.

A construction deadline for the project was also extended.

Hyperion's refinery north of Elk Point would process 400 barrels of crude oil each day.
